Welcome to Fables Farms, LLC (“we,” “us,” or “our”). By accessing or using our website at fablesfarms.com and purchasing products or services from us, you agree to comply with and be bound by the following terms and conditions. If you do not agree to the terms and conditions, please do not use this website.

PLEASE READ THE FOLLOWING TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THIS WEBSITE.

General Overview

Fables Farms, LLC provides fresh-cut flowers, heirloom peony roots, live plants, events, workshops, and farm products. All services and sales are subject to availability and these Terms & Conditions.

Plant Stock & Live Material Policy

All sales of live plant material—including peony roots, potted plants, tubers, and fresh-cut flowers—are final. Because live plant material is sensitive to environmental factors outside of our control once it leaves our property (such as planting depth, soil conditions, watering schedules, pest damage, and weather exposure), we cannot guarantee plant performance or survival after transfer of ownership.

We guarantee that all plant material is healthy, vigorous, and true-to-name at the time of pickup or dispatch. Any issues or damage incurred during transit must be reported with photos within 48 hours of receipt.

Pre-Orders & Harvest Schedules: Orders for roots or specialized stock are fulfilled based on natural seasonal digging and harvest schedules. In the rare event of crop failure or severe weather impacts, we reserve the right to substitute or issue a store credit/refund.

Orders, Pricing, & Shipping

Prices for our products are subject to change without notice.
Shipping timelines for peony roots align with optimal fall planting windows.
Customers are responsible for providing accurate delivery addresses at checkout.

On-Farm Visits & Events

Visitors to Fables Farms Peony Estate & Studio agree to follow all posted farm rules and staff guidance. Attendance at farm tours, private gatherings, workshops, or special events is at the participant’s own risk.

You Acknowledge that by participating in a on-farm or on-site visit or event that you have voluntarily decided to participate in an agricultural/farming activity located at 2367 Stratford Road, Delaware, Ohio, 43017 and that said property being owned by Derek & Elizabeth DeBrosse and/or Fables Farms, LLC. You acknowledge and understand that agricultural and farming activities may be hazardous and dangerous and involve both known and unknown or unanticipated risks which could result in damage or injury to you or others. You understand that such risks cannot be eliminated. These risks include, but are not limited to:

Unmaintained pathways and roads
Loose rock
Slippery Surfaces
Falling soil
Cracked walkways and uneven terrain
Normal natural vegetation and wildlife
Poor lighting
Others on the property
Farm animals
Farm equipment
Use of farming herbicides, pesticides and other non-natural chemicals
Various types of vegetation that may cause allergic reactions.

You further acknowledge that Fables Farms, LLC, it officers, owners, employees and agents have no duty to undertake first aid or first responder treatment in the event you suffer injury from any risk or hazard associated with any on-farm or on-site visit or event.

YOU ACCEPT OUR FACILITIES, PRODUCTS, AND EVENT INSTRUCTORS AS IS. WE MAKE NO WARRANTIES OR REPRESENTATIONS OF ANY KIND REGARDING OUR FACILITIES, PRODUCTS, OR EVENT INSTRUCTORS. WE FURTHER MAKES NO WARRANTIES OR REPRESENTATIONS OF ANY KIND REGARDING OUR DESIGN, MANUFACTURE, MAINTENANCE, CONDITION OR FITNESS FOR A PARTICULAR PURPOSE OF ANY FACILITY OR EQUIPMENT INCLUDING BUT NOT LIMITED TO: AGRICULTURAL STRUCTURES, FARMING EQUIPMENT, OR PRODUCTS. WE SPECIFICALLY DISCLAIM ALL REPRESENTATIONS AND WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

YOU AGREE TO ASSUME ALL RISKS AND LIABILITY ASSOCIATED WITH ANY ON-FARM OR ON-SITE VISIT OR EVENT UNDERSTANDING THE INHERENT RISKS ASSOCIATED WITH AGRICULTURAL/FARMING ACTIVITIES. YOU AGREE TO ASSUME ALL RISKS OF ACCIDENT OR INJURY AND RELEASE AND FOREVER DISCHARGE FABLES FARMS, LLC, ITS AFFILIATED COMPANIES, ITS OWNERS, AGENTS, OFFICERS, EMPLOYEES, SUCCESSORS AND ASSIGNS FROM ANY AND ALL LIABILITY FOR PERSONAL INJURY AND OR PROPERTY DAMAGE OF ANY KIND WHETHER SUCH PERSONAL INJURY OR PROPERTY DAMAGE IS CAUSED BY OUR NEGLIGENCE OR OTHERWISE. YOU AGREE THAT YOU ARE IN GOOD PHYSICAL HEALTH AND DO NOT SUFFER FROM ANY DISABILITY THAT WOULD PREVENT STUDENT FROM PARTICIPATING IN ANY AGRICULTURAL/FARMING ACTIVITIES.

You agree that you, your next of kin, heirs, guardians, representatives and assigns RELEASE AND FOREVER DISCHARGE (AND AGREE NOT TO SUE) Fables Farms, LLC its affiliated companies, its owners, agents, officers, employees, representatives, successors and assigns from and against any and all claims, demands, damages, expenses, causes of action, attachments of property, or liability of any kind whatsoever, that may result from your use of our products or your attendance at any on-farm or on-site visit or event, even if such claims, demands, damages, expenses, causes of action, attachments of property, or liability result partially or wholly from any act or acts, even any negligent act or omission to act, including negligent or omitted first-aid or rescue operations or procedures.

YOU AGREE that you, your next of kin, heirs, guardians, representatives and assigns will INDEMNIFY AND HOLD HARMLESS Fables Farms, LLC from and against any and all claims, damages, losses, costs or expenses (including reasonable attorneys' fees and disbursements) which arise directly or indirectly out of or are related to your use of our products or your attendance at any on-farm or on-site visit or event. This indemnification shall survive in the event this agreement is terminated for any reason.

Consent to Use Photo Likeness

In consideration for your ability to participate in any on-farm or on-site visit or event and all agricultural/farming activities we host, you grant to Fables Farms, LLC a worldwide non-revocable license and right of use of your name, voice, photograph, image and likeness, and any and all other distinctive and identifying indicia, for the sole purpose of marketing, advertising and selling of our services and products. You give this consent to Fables Farms, LLC without further expected compensation.

Rules & Regulations

You agree to strictly follow all rules & regulations communicated to you during any on-farm or on-site visit or event.

Error and/or Omission

We make every effort to have accurate and complete information on our website, including but not limited to pricing and availability, however, we occasionally make mistakes. You agree that you will not hold us liable for such mistakes or omissions and acknowledge that orders may be canceled after the fact due to errors or omissions.

Release of Liability, Agreement to Indemnify and Defend, Agreement to Hold Harmless

By placing an order with us, you explicitly agree to release Fables Farms, LLC, its affiliated companies, its owners, agents, officers, employees, successors and assigns, from any and all liability arising from or related to the products purchased to include, but not limited to, the use of the product, the storage of the product, and the transportation of the product. You also acknowledge that you are responsible for how you use the product and any third-party use. In the event that any other party files a claim of any kind against us, you will indemnify and pay to defend Fables Farms, LLC and its affiliated companies, its owners, agents, officers, employees, successors and assigns against any resulting civil liability or criminal prosecution.

Jurisdiction

You agree that if you, or someone else affected by your use of any product purchased from Fables Farms, LLC, brings a legal claim of any kind against us, or any of its affiliated companies, its owners, agents, officers, employees, successors and assigns, that such legal action must be filed in Federal Court in the United States District Court for the Southern District of Ohio located in Columbus, Ohio. You also agree that any complaints filed within any other jurisdiction shall be immediately terminated and moved to the Federal Court in the United States District Court for the Southern District of Ohio located in Columbus, Ohio, and agree to reimburse Fables Farms, LLC and its affiliated companies, its owners, agents, officers, employees, successors and assigns for any costs they may each incur in defending against the complaint or effecting its removal until such time that the complaint is properly filed in the Federal Court in the United States District Court for the Southern District of Ohio located in Columbus, Ohio. You further agree that any and all state actions must be brought/filed in Delaware County, Ohio. You agree that these terms shall be governed by and construed in accordance with the laws of the state of Ohio applicable to agreements made and to be performed therein.

Changes to These Terms

Fables Farms, LLC reserves the right, in its sole discretion, to change the terms under which www.fablesfarms.com is offered. The most current version of the terms will supersede all previous versions. We encourage you to periodically review the terms to stay informed of our updates.

Severability & Waiver

If any provision of these terms is held to be legally invalid or unenforceable, such invalidity or unenforceability will not render the entirety of these terms invalid. Rather, these terms will be construed as if not containing the invalid or unenforceable provision.

Merger Clause

These terms constitute a final written expression of all the terms and are a complete and exclusive statement of those terms. You agree that no representations or promises not expressly contained herein have been made or agreed to by us.
